#NEWS Lawyer sues IG, FCT CP, N8M breach of human right A legal practitioner, Mr Sebastine Abang, on Monday sued the Inspector General of Police, Abubakar Mohammed, and two other officers for N8 million for alleged breach of his fundamental human right. Others joined in the suit, file at FCT High Court in Wuse Zone 2, are the FCT Commissioner of Police, Mr Joseph Mbu, and Mr Daniel Musa, an officer in Dawaki Police Station, Kubwa. The Abuja-based lawyer alleged that he had on May 5 gone to Dawaki Police Station where his client, Mr Ade Adeboye, was detained by the police. He told the court that he told them at the station that his client was detained over a civil matter that could be settled amicably. Abang said he requested for bail of his client which annoyed the police officers, and they beat him to a state of coma. He said that he had served the officers the originating court process through the office of the FCT Commissioner of Police. Abang prayed the court for enforcement of his human right under the 1999 Constitution and under Article 4 and 5 of Africa Charter 1986. He is also seeking public apology to be published in two national dailies. Justice Valentine Ashi said all the defendants ought to be served the originating court processes before hearing could commence on the matter. I observed from the affidavit that only the 1st and 2nd respondents have been served. They all need to be served except you are going to withdraw the suit against the 3rd respondents. I have examined the provision of Order 11 rule 5; it empowers the court to give an order for substitution of service, where it appears difficult to effect service. Section 124 of the Evidence Act Provision also says public officers do not accept court summon directly except through their superior. “The 3rd defendant shall be served the motion on notice through the police legal department,’’ he said. Ashi adjourned the case until July 31 for hearing and ruled that hearing notice should also be served on the defendants.
