News from Greenbelt Action Group NEWSFLASH: Were delighted to announce that we have reached our fundraising total, the insurance premium has been paid to our solicitors Balfour Manson and our case was submitted to the Land Tribunal for Scotland on 1st September, 2014. As soon as Greenbelt Group receives the papers from the Tribunal, it has three weeks to state how it will respond. Many thanks to eveyone who has donated, fundraised or sent words of support. We received donations from homeowners from the South Coast of England to the North Coast of Scotland, from Northern Ireland and from Wales. We also received donations from homeowners beholden to Meadfleet and Ethical Maintenance. The legal case has been featured in the Sunday Times and Mike Marriott and MD of Greenbelt Group Alex Middleton have been interviewed about the case on BBC Radio Scotland [about 2 hours 36 minutes in]. The case will test two areas of law: Section 3 of the Title Conditions of (Scotland) Act 2003, which outlaws amongst other things the creation of monopoly scenarios in title deeds and scenarios - this could of benefit to all estates in Scotland with a land-owning land maintenance company The Competition Act 1998, which prevents the abuse of a dominant position - this could be of use to all estates throughout the UK. Our vision is that in 18 months time, every homeowner in the UK caught up in this situaiton will be able to quote a piece of UK case law - based on a high court ruling - which says that the land maintenance clauses in their title deeds are not compliant with law and are therefore unenforceable. Greenbelt Group is starting to launch legal actions again long term non payers - the test case could offer you immediate protection in the courts. Balfour Manson has said that anyone choosing to defend a case brought against them can print out a copy of this submission and ask the court for their case to be sisted [suspended / put to sleep] whilst the test case is underway. spanglefish/greenbeltgroupaction/
