Not everyone had a merry Christmas Not all had a Merry Christmas. In the early morning hours of Christmas Day, at approximately 0245 hours, a retired couple were abruptly awakened by the sounds of someone in their residence. The male home owner got out of his bed, armed himself with a hand gun and headed towards the noise. As he was walking down the hallway, he saw the light come on in the hallway bathroom. Due to the sounds and the light he believed someone was in the bathroom. As he opened the door he saw the window to the bathroom was wide open and that the screen had been removed. He saw a male subject, dressed in a heavy long, bright green jacket, on his hands and knees crawling on the floor in front of the commode. The commode is directly in front of the open window and due to the dirt on the commode and the position of the male, he believed the subject had just crawled through the now open window. The subject, who was later identified as Defendant, Jason William Hamilton, was wearing a large black handkerchief around his neck covering his face. Hamilton was detained at gun point and told to lay on his stomach and not to move. Hamilton laid on his stomach but continued to crawl towards the owner of the residence. The owner continued to tell Hamilton to stop moving, but Hamilton refused to stop. While the owner was attempting to detain Hamilton, his wife called 911 for assistance. While deputies were responding to the residence, Hamilton continued crawling down the hallway towards the front door of the residence. Once Hamilton reached the front door, he opened it, stood up and ran north bound away from the residence. Just after Hamilton ran from the residence deputies from the Shasta County Sheriff’s Office arrived at the residence. Deputy Gerry Maul and his K-9 partner Larus started a track from the front of the residence. Larus headed north then turned east headed towards the back of the residence. Larus followed Hamilton’s scent for approximately three fourths of a mile over two fences and up and down two heavily rocky and brushy ravines. Larus located Hamilton hiding in the heavily wooded area. Hamilton initially resisted being apprehended by Larus, but after a short altercation Hamilton was taken into custody. Hamilton was transported to Shasta Regional Medical Center where his injuries were treated. After receiving a medical clearance from SRMC, Hamilton was booked into the Shasta County Jail. A check of prior contacts with Hamilton showed prior arrests for Robbery, Burglary, Domestic Violence and several Parole Violations.
