Open letter to all state elected officials congressmen and senators: Dear your rep/sen, Allow me to thank you for your service to our state and nation, and, as always, I pray for Our Eternal Father’s blessings upon you and that He guide you in your actions and direct you to moral decisions as they affect us all. I write this letter as a concern for the radical activism currently being displayed by the judicial branch at both the state and national levels. They have gone unanswered and are not being held accountable to the people. Your branch, not the judicial branch, is empowered to write laws. That power is granted to your branch by WE THE PEOPLE. Our US Constitution empowers us with the authority to remove a judge that oversteps his authority. If I am not mistaken, at least 13 times in our nation’s history, federal judges have been removed from office by impeachment proceedings. Don’t all judges take an oath to uphold the Constitution as the supreme law of the land? Does not that supreme law specify the duties of each of the 3 branches? How can that one black robe dismantle the process outlined in the Constitution? That process does NOT allow for him to set himself up as a dictator to determine or overrule the will of WE THE PEOPLE! All Judges swear an oath to uphold the Constitution as the Supreme Law of the Land. It’s spelled out in Article 6 of our US Constitution. Yet, rather than upholding the Constitution, some Judges, like U.S. District Judge Terence Kern, are using their gavel to legislate radical political views. That power is not granted to them by the Constitution. If any Judge tries to make the Constitution say something other than what its framers intended, or tries to legislate law from the bench, it is permissible—legally--to impeach that Judge and remove him from office. According to the Constitution, WE, THE PEOPLE, have the authority to impeach and remove any Judge who is guilty of legislating from the bench. That Judge has broken his oath of office and can be removed. These activist Judges have taken power unto themselves because we’ve refused to stop them! It is time to exercise courage and hold them accountable for their actions! Reneging on a sworn oath of public office falls under the definition of treason. In addition, legislating from the bench falls under the more broad definition of other high crimes and misdemeanors. The first amendment of our Constitution specifies that WE, THE PEOPLE, are allowed to petition to the government for a redress of grievances. WE are allowed to list our grievances concerning a judge (elected or appointed) or any other elected official. We can then submit our petition to a member of our federal or STATE House of Representatives to consider the impeachment of the official. To initiate impeachment proceedings, the options always exist with WE THE PEOPLE in with following: * the impeachment proceedings can either be commenced by a member of the US House, * or the proceedings may be initiated by a member of the state House, * or be recommended by any US citizen. I beg of you to seriously consider my petition of grievance and implore upon you to exercise courage to act in accordance with the will of the people whom you represent; to answer to those of us who wish to hold officials accountable as per the Constitution; and to act in a way consistent with the word of God, who is the granter of these rights we hold so dear, but are losing at the hands of activists judges with a radical political agenda. I share with you my kind prayers for the protection & blessing of our common Father and Creator of man. Sincerely, Gary L. Barksdale
