I wonder where all that stands, because some of the charges go back to “lying” at bankruptcy hearings, but they withdrew their petition. We know a couple that told their lawyer all the details when they filed bankruptcy and the lawyer filed the petition and it was granted. However, the lawyer kept putting the wrong address on something (entirely their mistake), it opened up some legal issues a few years after the bankruptcy was discharged, and our friends became entangled legally because they said that they did not update the court and because the lawyers kept trying to get it straight about the address, that the file was still open and our friends were required to inform the court of changes. It became a big legal mess for our friends, who informed the attorney of every little detail and it was clerical error on his part, but the court didn’t care because for one all attorneys consulted and involved agreed that a Trustee gets assigned and can rack up quite large legal fees because he opened an investigation. Meantime, he isn’t really doing much because the defendants’ lawyer and the lawyers for the creditors are doing all the negotiations. They all agreed thought that this is how the system works and the Trustee, who is an attorney, can make a very large fee. Since this bankruptcy was withdrawn, but they decided to investigate anyways, the Trustee wanted to keep this open to rack up legal fees for himself, and there is no negotiation there–if he says you owe a Trustee’s fee of $100,000, then you have to pay that–no proof of time spent on the case–no negotiating a lower fee, etc., and your file cannot be completed or closed until the Trustee collects that fee, so you have no choice but to pay the amount that they charge. I am sure since their petition was withdrawn, the only way the Trustee continued to collect was to open an investigation because with the withdrawal, his services were no longer needed. Several lawyers told our friends that filing a bankruptcy is a big business as far as attorneys that get assigned as Trustees, because this is a “freebie” for them, as far as the fee. It is other attorneys or accountants, etc. that do most of the work than the Trustee actually does, but he collects that fee and there is nothing anyone can do about it. I am not condoning any wrongdoing on anyone’s part, but since they withdrew their petition, I would like to know if these mortgage holders have been paid, and if they have been, then it is about the government making the money now and the lawyers and staff that are the Trustee in this case. I am reserving judgment on all the charges, and again I don’t condone it, but so many corporations get away with so much, and mortgage brokers who encouraged people taking loans that became the “mortgage crisis”, and there were no real repercussions for them. We know many self-employed people, and a mortgage broker would approach them and encourage them to give a statement of income, essentially just saying you made so much money, without having to prove it, because they wanted the loan. I have a feeling that some of that went on here, since they say Joe was self-employed. The non filing of tax returns is another matter, but again I am curious because they only claim that Joe didn’t file, but this is not one of the charges against Teresa. If the cast and their on camera rants about the Giudices’ legal and financial problems played a part in this, then I hope karma comes back to bite them. Jacqueline especially kept bringing it up, and saying that Teresa had a plan to go back and screw the creditors out of $11,000,000, when they were at Melissa’s launch party (when Melissa and Teresa discussed TSIL contacting Danielle). At any rate, I am going to reserve judgment, pray for them (they have 4 young children), and wish them the best of luck. Teresa and Joe both showed how mature and truly loving they were in yesterday’s episode. Joe in particular, showed such class about forgiving and letting go of things, no matter how bad family and friends tried to hurt them. I was really impressed with Joe regarding the Lauritas and his talk with Teresa, who was extremely anxious about talking to Jacqueline (personally I would have given her the opposite advice). I admired his maturity and feelings regarding letting go of the past. I realize that he has probably made some financial mistakes, but he has been showing us that he is respectful and more forgiving and classy than these other idiots on the show. Whatever his mistakes, I won’t take away what we have seen from him this season with Teresa, his children, his elders and even the rest of the cast. He has shown more respect than all the others put together, and that he truly says he is over it, and is really capable of putting it behind him and move on and give them all another chance. I wish him and Teresa much luck with this latest news.
