Please Oppose Internet Sales Tax Legislation in the Lame Duck Dear [Senator], As your constituent, I ask that you oppose attempts to bypass the normal legislative process and force a vote on the Senate-passed Marketplace Fairness Act in the “Lame Duck” session. The Marketplace Fairness Act will hurt small online businesses by giving them the same tax obligations as multibillion dollar retailers who not only have a physical presence nationally, but receive government tax breaks that are not available to small businesses in many states. The legislation will also give tax collectors in every state unprecedented authority to threaten out-of-state small businesses with costly audits and unnecessary litigation. The Marketplace Fairness Act includes a $1 million small businesses exemption in gross online sales. This threshold will not protect our nation’s small businesses and will discourage future growth, harming job creation in our local communities. Furthermore, I fear that if the Marketplace Fairness Act is not handled in the regular legislative process, there will not be any opportunity to meaningfully amend the bill. I believe that more scrutiny is needed to ensure the protection of small businesses and I would encourage you to oppose any effort to move this legislation in the final weeks of this Congress. Legislation should support small businesses, not put them out of business. Unfortunately, the Senate-passed Internet sales tax legislation will make these businesses less competitive against big national retailers. Please speak up and oppose efforts to move the Marketplace Fairness Act during the “Lame Duck” session.
