RE: Judge Andrew Napolitano: “The Truth Shall Keep Us Free” gopusa/commentary/2013/06/27/napolitano-the-truth-shall-keep-us-free/?subscriber=1 Judge Napolitano’s comments are thoroughly apt and the comments by AIM Report, whom I usually respect, condemning both Edward Snowden and Judge Napolitano are clearly out of line. I have two questions for the Judge or for any other lawyer specializing in Constitutional Law. Is there no statute providing punishment for Contempt of the Constitution by a public official? Likewise is there no statute providing punishment for perjury on his oath of office by a public official? Every Federal official is sworn to support, uphold, and defend the Constitution, and all states have a similar requirement for their officials. Just as without law there can be no punishment (Nulla poena sine lege) is the basic principle of the rule of law, the flip side is also true, for all practical purposes without punishment for all practical purposes there is no law. If there is no statute providing punishment for rogue public officials who walk all over the Constitution, doesn’t that leave the Constitution nothing but a nice wish list with no teeth? The FISA court is clearly a Court of the Star Chamber of the sort the founders particularly had in mind in writing the Fourth Amendment, the warrant for the phone records of 113 million people far surpasses the British warrant for “The Printers and Publishers of The North Britain” which brought the issue of general warrants to the fore in both Britain and the Colonies in the 1760s, and a lie to Congress is, if I am not mistaken, a three year felony. It is Attorney General Holder’s job to prosecute these matters. If he refuses to do so, then Congress is quite justified in impeaching, trying, and removing him.
