RE: Judicial Com plaint, Case No. 12-90022-JM I hereby petition the Judicial Council for review of the Chief Judge’s order. Did the Chief Judge err in overlooking documents that were crucial to the petitioner’s complaint? Five identically –worded letters from family members and codefendants, each stating, “ I was present in the court room during the judge’s racial remarks to the jurors and I would like to be either interviewed for this matter or an opportunity to submit an affidavit attesting to facts that occurred. “ I have spent the past 9nine and a half years searching for those particular transcripts. These are not government witnesses expecting to get a 5k1; all were asking for the opportunity to tell what they witnessed during the vodire session, I also sent the same letter to my trial attorney, Mr. Van White. He also was aware of the truth of this matter that took place during the vodire session. We spoke about it taking place several times during the trial. He also asked me my thoughts on the Judges remarks. I gave him the same answer I gave Chief Judge Jacob in the complaint. If those letters were in support of something the government brought forth, their character would not be in question and they would have been interviewed already. Mr. Van White was probably too embarrassed to submit his letter because of his ineffective counsel and for not protecting my constitutional rights. I ask this counsel to please consider an interview with those witnesses as well as put Mr. White under oath. The Judge planted a racial seed in the juror’s pool before we proceeded with the trial so he could how crafty and vindictive he could be by misusing his authority to highjack the law to his advantage. In the same way he abused his authority to vodire the jury pool, knowing exactly what kind of jurors he was looking for. They even went as far to have the prosecution specifically state that if another ex defendant was prosecuted that they would face an ALL WHITE jury from the suburbs while none of them would be a jury of their peers. Of the thirty five jurors left to choose from, eight were black and twenty seven were white. The black jurors were plucked right away, one black man was dismissed for being too educated and having too many degrees fearing he could persuade the jury to see his side of the law. After the 12 were seated and the alternate was in place the jury consisted of nine white women one black woman and two white men. A make up very similar to that of the O.J Simpson trial that the Judge inexplicably referenced as soon as the jury pool was selected. The judge instructed the prosecutor to place the black woman alternate left at No. 6. The Judge made sure everything was in place for this first time prosecutor. One white woman let it be known she understood the Judge’s racists, coded remark and she did not want a part of this Jim Crow Lynching. She told the judge that she could not serve on this jury because these black men were not going to get a fair trial. She said just take a look around at all these white folks and just imagine how they perceive your coded racist messages. A few more white Christians asked not to be a part of the Judge’s crafty clever scheming deceitful court still practicing Jim Crowism. One juror cried after a black man gave the jury foreman a compliment on her behind/backside, during the lunch break hour. She came into the courtroom crying like one of her family members had died. And she left the courtroom displaying the same theatrics. It looked as if it was staged to be a distraction or another tactic used by the Judge because there was no reason for this lady to be crying like that making a spectacle of the court simply because a black man gave someone else a compliment. There is no way that this lady could be fair or impartial to my co defendants or me. This incident is just as equal in comparison to the note that the juror’s husband sent to the Marshall, which leads me to discuss the jury foreman who was just as manipulating and disrespectful as The Judge. Whenever the prosecutor was leading the female juror could be writing and taking notes, but when the cross examination took place she would fold her arms and give the defendants a nasty look and roll her eyes to the ceiling. Based on to the interruption due to the jurors crying performance the jury was supposed to be sequestered after wards but when the Judge had them all brought in Individually to question them on the matter they had already discussed the situation with themselves, with the exception of the black juror because she felt uncomfortable in leaving the court room with the defendants after the note came. The jury foreman said she and others had discussed this amongst themselves. They were not fit to be jurors after the coded, racist remarks came into fruition. The Judge had no choice but to address these issues that had trickled down from his racist remark. Ask yourself why these jurors acted the way they did? No matter how the Chief Judge uses all the beautiful words to cover up Judge Siragusa and the jurors misconduct, it will not change the truth of the matter. Even if he does not have the liberty to rule on the issues brought forth in the amended complaint, the exhibits speak for themselves. Including the fraudulent indictment the hiding of the wiretaps, and the conspiring 2255 motion. These issues are too fresh to be called stale. The truth will NEVER die. God made that clear to Cain in Genesis Chapter 4, vs. 8-10, where Cain hid Abel’s body in the earth “The voice of thy brother’s blood crieth unto me from the ground. If there was no merit to the 2255 I filed the Judge would have never ordered the government to answer it. We can bury the truth but it will never be in vain, if you only uncover the mirror and take a look into it you just might see justice! Our thirty fifth President, John F Kennedy, said it the way it should have been said: “ Ask not what you country can do for you, ask what you can do for your country.” Uncover the mirror of truth and let justice flow Respectfully 9/25/2013
