"to support and defend the Constitution of the United States against all enemies, both foreign and domestic" ..... therefore as a Veteran, and as a Citizen, do I or would I, in specific terms of that Oath, have justification or legal standing to file criminal charges, against POTUS Obama for Treason and, or other high crimes? ------------------------------------------------------------------------ Articles of Impeachment House Judiciary Committee, ________________, 2013 H.RES.___ Resolution Impeaching Barack Hussein Obama, President of the United States, for high crimes and misdemeanors. Resolved, That Barack Hussein Obama, President of the United States, is impeached for high crimes and misdemeanors, and that the following articles of impeachment be exhibited to the United States Senate: Articles of impeachment exhibited by the House of Representatives of the United States of America in the name of itself and of the people of the United States of America, against Barack Hussein Obama, President of the United States of America, in maintenance and support of its impeachment against him for high crimes and misdemeanors. ARTICLE I. In his conduct of the office of President of the United States, Barack Hussein Obama, in violation of his constitutional oath faithfully to execute the office of President of the United States and, to the best of his ability, preserve, protect, and defend the Constitution of the United States, and in violation of his constitutional duty to take care that the laws be faithfully executed, has usurped the exclusive power of Congress to authorize the initiation of war under Article I, section 8, clause 11 of the United States Constitution. Without congressional authorization expressed through a duly enacted law, the President unilaterally commenced war and employed the United States military in offensive action against the Republic of Libya on March 19, 2011. President Obama, through his subordinates, has declared that Congress is powerless to constrain his conduct of the war or the initiation of any other war, including a war against Iran professedly to defeat its nuclear ambitions. He has claimed constitutional authority to take the nation from a state of peace to a state of war whenever he proclaims that belligerency is in the national interest, including to support the “credibility and effectiveness” of the United Nations Security Council. By so doing and declaring, Barack Hussein Obama has mocked the rule of law, endangered the existence of the Republic and the liberties of the people, and perpetrated an impeachable high crime and misdemeanor. Wherefore, Barack Hussein Obama, by such conduct, warrants impeachment and trial, and removal from office and disqualification to hold and enjoy any office of honor, trust or profit under the United States. ARTICLE II In his conduct of the office of President of the United States, Barack Hussein Obama, in violation of his constitutional oath faithfully to execute the office of President of the United States and, to the best of his ability, preserve, protect, and defend the Constitution of the United States, and in violation of his constitutional duty to take care that the laws be faithfully executed, has usurped the exclusive power of Congress to authorize the initiation of war under Article I, section 8, clause 11 of the United States Constitution. Without congressional authorization expressed through a duly enacted law, the President unilaterally commenced war and employed the United States military in offensive action within the Islamic Republic of Pakistan on May 2, 2011: Operation Neptune Spear. Barack Hussein Obama, through his subordinates, did not share information about the raid with the government of Pakistan until it was over. Sources indicate Barack Hussein Obama decided against informing or working with Pakistan, consistent with a confidential Presidential advisor’s assessment that there was “a real lack of confidence that the Pakistanis could keep this secret for more than a nanosecond.” Barack Hussein Obama has claimed constitutional authority to take the nation from a state of peace to a state of war whenever he proclaims that belligerency is in the national interest, including to support the “credibility and effectiveness” of the United Nations Security Council. Fielding a question from the audience as to whether he would pursue Al Qaeda leaders inside Pakistan, even if that meant invading an ally nation, then candidate Obama replied with a statement of prospective policy consistent with customary international law, wherein sovereignty of the state is not absolute under international law or impervious to the reach of another nation in its exercise of self defense. He said: “If we have Osama bin Laden in our sights and the Pakistani government is unable, or unwilling, to take them out, then I think that we have to act and we will take them out. We will kill bin Laden. We will crush Al Qaeda. Without congressional authorization expressed through a duly enacted law, the President continued air-to-ground strikes of the preceding Administration and employed the United States military and the United States Central Intelligence Agency assets in offensive action within the Islamic Republic of Pakistan. In the first major Pakistani court ruling on the legality of the CIA’s drone campaign in the country, a Peshawar High Court judge said this morning that strikes are ‘criminal offences’. Chief Justice Dost Muhammad Khan ordered Pakistan’s government to ‘use force if need be’ to end drone attacks in the country’s tribal regions. Chief Justice Dost Muhammad Khan ruled that US drone strikes in Pakistan constitute a ‘war crime’ and are a ‘blatant violation of basic human rights’, killing hundreds of civilians. Wherefore, Barack Hussein Obama, by such conduct, warrants impeachment and trial, and removal from office and disqualification to hold and enjoy any office of honor, trust or profit under the United States. In addition Barack Hussein Obama and members of his Administration must be made available to the International Court of Justice should the Pakistani Government decide to pursue “War Crimes” and “Crimes against Humanity” for the deaths of its civilians. ARTICLE IV In his conduct of the office of President of the United States and as Commander-in-Chief of the United States Armed Forces, Barack Hussein Obama violated duty is to protect and secure American Soil. The order that ultimately rested with President Obama to provide aide to Ambassador Stevens at the Benghazi Consulate in Libya, was to "Stand Down" or do nothing. Wherefore, Barack Hussein Obama, by such conduct, warrants impeachment and trial, and removal from office and disqualification to hold and enjoy any office of honor, trust or profit under the United States. ARTICLE V In his conduct of the office of President of the United States, Barack Hussein Obama, in violation of his constitutional oath faithfully to execute the office of President of the United States and, to the best of his ability, preserve, protect, and defend the Constitution of the United States, and in violation of his constitutional duty to take care that the laws be faithfully executed, has usurped the exclusive power of Congress to authorize the initiation of war under Article I, section 8, clause 11 of the United States Constitution. ARTICLE VI In his conduct of the office of President of the United States, Barack Hussein Obama, in violation of his constitutional oath faithfully to execute the office of President of the United States and, to the best of his ability, preserve, protect, and defend the Constitution of the United States, and in violation of his constitutional duty to take care that the laws be faithfully executed, has usurped the exclusive power of Congress and has used the privilege of "Executive Orders" to direct actions of the Executive Branch of the Government to bypass laws enacted and signed into Law; i.e., the direction of the U.S. Department of Homeland Security to not enforce Immigration Removal procedures within the Immigration and Customs Enforcement Branch. Wherefore, Barack Hussein Obama, by such conduct, warrants impeachment and trial, and removal from office and disqualification to hold and enjoy any office of honor, trust or profit under the United States. ARTICLE VII In his conduct of the office of President of the United States, Barack Hussein Obama, in violation of his constitutional oath faithfully to execute the office of President of the United States and, to the best of his ability, preserve, protect, and defend the Constitution of the United States, and in violation of his constitutional duty to take care that the laws be faithfully executed, has usurped the exclusive power of Congress and has used the privilege of "Executive Orders" directing the Environmental Protection Agency to unilaterally set carbon emission standards, thus bypassing Congress which opposes Obama’s energy reform bill. Wherefore, Barack Hussein Obama, by such conduct, warrants impeachment and trial, and removal from office and disqualification to hold and enjoy any office of honor, trust or profit under the United States. ARTICLE VIII In his conduct of the office of President of the United States, Barack Hussein Obama, in violation of his constitutional oath faithfully to execute the office of President of the United States and, to the best of his ability, preserve, protect, and defend the Constitution of the United States, and in violation of his constitutional duty to take care that the laws be faithfully executed, has usurped the exclusive power of Congress and has used the privilege of "Executive Orders" directing the Department of the Interior to implement a third oil-drilling moratorium after the first two were thrown out of court, creating a de- facto Gulf Coast offshore drilling ban in opposition to two judge’s rulings. Wherefore, Barack Hussein Obama, by such conduct, warrants impeachment and trial, and removal from office and disqualification to hold and enjoy any office of honor, trust or profit under the United States. ARTICLE IX In his conduct of the office of President of the United States, Barack Hussein Obama, in violation of his constitutional oath faithfully to execute the office of President of the United States and, to the best of his ability, preserve, protect, and defend the Constitution of the United States, and in violation of his constitutional duty to take care that the laws be faithfully executed, the Department of Homeland Security policy of intentionally not securing our nation’s borders, in opposition to Article IV, Section 4 of the Constitution which calls for the President to protect states from foreign invasion, in an attempt to blackmail Republican support for comprehensive immigration reform. In essence, Obama is holding Border States and residents politically hostage during a time they are being overrun by a narco-paramilitary invasion. Wherefore, Barack Hussein Obama, by such conduct, warrants impeachment and trial, and removal from office and disqualification to hold and enjoy any office of honor, trust or profit under the United States. ARTICLE X In his conduct of the office of President of the United States, Barack Hussein Obama, in violation of his constitutional oath faithfully to execute the office of President of the United States and, to the best of his ability, preserve, protect, and defend the Constitution of the United States, and in violation of his constitutional duty to take care that the laws be faithfully executed, has usurped the exclusive power of Congress and the Recess appointment of Donald Berwick (July 6, 2010) as head of the Centers for Medicare and Medicaid Services without even a token attempt to put him through the Congressional nomination process, signaling that Congress’s constitutional obligation to vet presidential appointees means nothing to Barack Hussein Obama. The same can be said of the 30+ administration czars. Wherefore, Barack Hussein Obama, by such conduct, warrants impeachment and trial, and removal from office and disqualification to hold and enjoy any office of honor, trust or profit under the United States.
