Set to appear on Pat McMahons A.M TV show, The Morning Scramble, on KAZ TV 7 or Cable Channel 13, this Wed. Nov. 26, during 8:00am hour. Topic is Immigration and Pres. Obamas Executive Order. Sorry, nativists, my opinion is its constitutional. Only issue is if it goes too far, not if a Pres. has the power to use executive discretion in enforcing law. We have a system of 3 co-equal branches of govt. Tension was built into the process. Every time a cop on the street stops you for speeding and says Im only giving you a warning is exec. discretion (although that simple example is regarding state, not federal law). No one would want to live in a system of strict discretion-less enforcement; that would destroy all equity. Further, as the Supreme Court made clear, being in the US illegally is not by itself a crime! It NEVER has been. As long as there have been immigration laws Congress has given the Exec. discretion to civilly deport, criminally charge, or permit one to stay. An Exec. order IS the supreme law of the land - unless Congress or the courts overturns it. Congress could overturn this order, but needs a veto-proof majority to override the Presidents expected veto - otherwise the Exec. order remains law. Alas, the tragic part is that both parties might prefer to not resolve the matter, at least for now - it gives them an issue to run on for the next election, anger their base, and raise contributions. Disunity is so prevalent that worse is now better.
