THIS IS WHERE THE ELECTORAL ROLL CAN BE CLEANED OF UNDESIRABLE ELECTORS/VOTERS IN YOUR CONSTITUENCY. Excellent advice from J D Foukona- a prominent lawyer & PHD Student giving his opinion in Lau/Mbaelelea Forum. “Some members of our Forum have raised the issue of people not “ordinarily resident” in LM registering as voters for LM constituency. There is a process under our electoral law to address this issue (see National Parliament Electoral Provisions Act, section 19 (2)). Here is a brief outline of the process: 1) After completion of registration the Registration Officer or Assistant Registration Officer will publish a list of voters deemed entitled to be registered in that ward of a constituency. This list will be published in an adequate manner so that persons entitled to be registered in the ward can view it (see s18 NPEP Act). 2) Any person whose name appears in the published list may object to any other person whose name also appears therein as not being entitled to have his/her name retained on the list (see s 19 NPEP Act). 3) The person who makes an objection must give notice in writing in Form E (Second Schedule) to the Registration Officer or an Assistant Registration for the ward concerned. 4) This same notice in writing in Form E must also be given to the person objected to. 5. Time-frame to give notice – within 10 days after the list of voters is published.”
