Tenacity and resistance culminated yesterday in the Director of Public Prosecutions deciding (two days after the trial was scheduled to commence) to take no further proceedings against Margaret Bateman’s client in respect of a charge of break and enter and commit serious indictable offence therein in circumstances of aggravation (pursuant to subsection 112(2) of the Crimes Act 1900 (NSW)). Such offence carries a maximum sentence of imprisonment for 20 years and a standard non-parole period of imprisonment for 5 years. The Defendant maintained his innocence at all times and is relieved not to be incarcerated, relieved to no longer be on bail (ending his reporting conditions) and relieved not to have the matter hanging over his head any longer.
