Thanks for the info D :) BE AWARE OF scare tactics regarding fines and know your rights Not only are they threatening to clamp cars but they are also threatening to publicly reveal the identity of people who have large numbers of outstanding fines. Please remember the following important points: Firstly, as we explain in our e-book (AUSSIE SPEEDING FINES), pursuant to Section 8, Sub-Section 12 of the Imperial Acts Application Act, “All fines and forfeitures before conviction are illegal and void” – if you haven’t been to court and convicted of anything, the fine, and any subsequent action, such as wheel clamping, is illegal and void. Secondly, once a set of clamps is attached to your vehicle, it becomes a chattel – or a fixture – of the vehicle and it becomes your property – you are, therefore, 100% within your rights to cut it off, put it in your boot and write back to them and tell them to pay you storage for their clamps if they want them back. And, thirdly, the Privacy Act is very clear on information that can and can’t be disclosed. The Privacy Act is Commonwealth legislation and, again, as we explain in our e-book – Section 109 of the Commonwealth Constitution says that where there is an inconsistency between a law of a Sate and a law of the Commonwealth then the latter prevails. Accordingly, no State statute can allow the WA government, or any of their private agencies, to reveal your personal details or details of any alleged “fines” you have outstanding, especially if you have never been convicted of anything in a court of competent jurisdiction! Despite all of that, however, our greatest concern is with the 3rd last paragraph of that article which insanely suggests that “The rest of the population is having to carry them (offenders) for their breaches of the laws and failure to pay their fines.” Now considering that fines are, according to them, not about revenue raising then what exactly is it that the “rest of the population” is “carrying”???
