The Houston Chronicle published an article titled “Largely Invisible Tank Cleaning Industry Awash in Risk” that discusses the many dangers and risks of cleaning tanks and barges and how these sites are not sufficiently inspected by Occupational Safety and Health Administration (OSHA). The article features the case of David Godines who died while cleaning a tank car. Firm Partner Mo Aziz represented the widow and children of David Godines in a wrongful death lawsuit against Lubrizol Corp. and Austin Industrial, Godines’ employer. Although OSHA listed the case of the incident as employee misconduct, after taking more than 20 depositions, Aziz was able to establish that the Confined Space Entry Program at the chemical facility was flawed and posed a danger to the tank car cleaners. The case was settled for $2.3 million two weeks before trial.
