There was a mix up yesterday at the Abuja Division of the Court of Appeal when the appeal involving the eligibility of President Goodluck Jonathan to contest the 2015 election came up. The appeal filed by a PDP aspirant, Dr. Umar Ardo, who wants the Appeal Court to join him in a suit against the president’s candidacy as an interested party, was meant to come up but when the case was called up it was Cyriacus Njoku that stood up as the applicant. Njoku’s appeal case number is CA/ ABJ/ 574/ 2013 but when Ardo filed his appeal, his case file was tagged CA/ABJ/574/A/ 2014 which led to the registry of the Court of Appeal opening two case files for one appeal. Ardo had applied to be joined in the appeal against the judgement of Justice Mudashiru Oniyangi, which declared that President Goodluck Jonathan is eligible to contest the 2015 election. Ardo, through his counsel, Dr. Amuda Kannike (SAN), in a motion on notice begged the court to join him as an interested party case filed by Njoku. It was this motion that was slated for hearing. Justice Oniyangi who was a judge of the High Court of the FCT, (now elevated to the Appeal Court) dismissed the case brought by Njoku and declared that President Jonathan is eligible to contest next year’s presidential election. When the case was called up, it was the case file with CA/ ABJ/ 574 filed by Njoku that was brought to court and not the CA/ABJ/574/A/ 2014 filed by Ardo that was slated to be heard. Meanwhile, the court has ordered parties in the case to go to the court registry to resolve the issue as the court is likely to hear the appeal next week in view of the fact that the 2015 election time table is out. dailytrust.ng/daily/politics/37321-appeal-court-to-commence-hearing-on-jonathan-s-eligibility-case-next-week
