When I was still a struggling law student, I happen to ask my professor, out of curiosity, why use double negative when we can simply use a positive statement. The briefer of Te in a footnote of RH Laws decision is an added light. The SC used the term NOT UNCONSTITUTIONAL, not constitutional. It matters. The double negative was used because “all laws are presumed to be constitutional and the burden of showing that a law is unconstitutional is on the petitioner.” “Failing that burden, the declaration is in the double negative—not unconstitutional,” the briefer said. Ang pagiging #DoubleNegative sa buhay, minsan, ay may silbi. 🙊
