Whither canonical form? The primary question regarding ‘canonical form’ (1983 CIC 1108 ff) is not whether form does any good, for of course it does. The primary question is whether the good that canonical form does comes at too high a price and, if so, whether the good that form does can be achieved in other less costly ways. The answer to both questions is, yes: The price of canonical form (chiefly, but not solely, allowing thousands of Catholics annually to walk away from weddings that we require the rest of the world to respect) is too high, and, the good that canonical form does can be achieved (and already is achieved by the rest of the world, baptized and non-baptized alike) in any publicly recognized wedding ceremony.
