Would you act for a family member in their divorce case? You cousin approaches you for a favour at a family function. He has been paying lots of money for a well known lawyer to settle his divorce but it has been going on for 18 months. Now it is headed to the High Court. There is relationship property, trusts and custody stuff to sort out. The matter is turning nasty. Your cousin left you his beach front house on Waiheke last summer for one week. You feel you owe him. Your wife says you should act and you mum has put pressure on you. Do you act for him? What you need to consider: - For you the case is professional and not emotional but can you stay removed from the client? - The relationship with your cousin needs to last a lifetime. - What will the other lawyer and Judge think of your position? - What do other family members want? - How will the legal costs be covered? Answer In my opinion the answer is No. This is a really easy decision given the factors to consider. Refer your cousin to another good family lawyer. Keep your reputation intact with other lawyers and your friendship with your cousin.
