chances are that i will beat the possession charges because of an illegal search of my car. you actually have to be under arrest before they can search your car legally and even then it is only the immediate area that you are in( if you are in the drivers seat then only the area immediately surrounding the driver). even if they do arrest you for something they have no right to search your trunk. this is why library cards rock! i believe the cops knew they were searching my car illegaly, and that as long as i got competent representation, i would get off. but the system still wins because: 1. i end up having to pay a lawyer to defend me.$750-$1500 2. if they find anything. they can impound my car and i will have to pay to get it back.(this is not refundable, even if you win the case, because of suppression of evidence. it is a seperate hearing where the burden of proof is a lot less.)$250-$3250 3. if my defense is incompetent, i end up paying a fine and possible jail time.$0-$4000 the system is perfect. whether you are right or wrong, win or lose, you pay the system.
