I am glad this chapter is behind me although I am still suffering consequences such as now as I am admitted in Cabell Huntington due to complications from a recent surgery. Unfortunately due to multiple doctor appointments I was unable to attend the sentencing and recitate my victim impact statement to the piece of trash that ruined my life. So, with the availability of social media I will post my statement to unto-hear for those not present during the proceedings to read and get an understanding of how this incident has ruined my life. The letter was directed to my good friend and victim advocate to read on my behalf. July 28, 2014 Dear Ms Susan Grady, After working with you for several years I request, you, to be present during sentencing of Mr. Cole Miller and address the court the following statement made by me, as a victim. My absence during todays proceedings are due to two doctor appointments I am scheduled for. My statement to the court is as follows: Your Honor, thank you for the time in expressing this statement on behalf of Officer Jamie Bartels who is unable to be here due to drs appointments. Even though this case has been on the courts docket for just over 22 months, I will not present myself as the defendant has in wasting your courts time. Prosecutors Mulfurd and Wiseman, thank you behalf of me,Officer Bartels , the victim, for working diligently along with investigating officers, and cooperating witnesses in preparing an outstanding prosecution. Mr. Shamansky, Officer Bartels, would like to thank you in doing your job as required by law in providing an adequate defense to your client....a poor one, but yet adequate. Your legal review researched through internet services are quite misconceived among people considering your client has essentially gained nothing from your expensive fees. In reading feedback from previous clients, I truly believe you or your staff has posted the comments based on grammar and other signs because your presence was definitely unimpressive and getting your client off definitely was a joke in this case. Cole Miller, youre actions the night of September 24, 2012 has done nothing more than merely ruining the lives and livelihood of several people; most importantly Officer Jamie Bartels and your newly born child. In knowing and working with Officer Bartels both personally and professionally for several years, you could not have encountered a more fair, equal, and professional person than Officer Bartels. But you selected the path of most resistance; therefore, what Officer Bartels believes is mis-guided behavior you had growing up as a child and adolescent has now ultimately resulted in the time for you to face the consequences of serious penalties. You know exactly how your aunt, Jackie Grate, works when it comes to dealing with law enforcement. As she has done many times in the past with your uncle, Keith Grate at times when he would smack around on her; she would call 911 or call the sheriffs office, make a complaint against him, he then ultimately spends a night in jail. When it would come time to follow through with criminal charges in the court system then she would be in love with him again and ultimately drop the charges or be an uncooperating witness and the charges would ultimately be dismissed. The night you and Jackie decided to embellish in your childish behavior that permanently altered My life both physically and psychologically would most likely have played out in the aforementioned scenario between Jackie & Keith. If you wouldve been man enough to talk to Me and my partner, Officer Schuldt, the maximum that wouldve most likely played out would have been a couple nights in jail then Jackie wouldve fell back on her track record of being an uncooperative witness and charges wouldve been dropped resulting in you being a free man. You call yourself a Marine but youre nothing but a (cumchow). If you ever spent time in Okinawa, Japan then you know what you truly are. If not, then youll have plenty of time to study the Japanese language while spending time in the state pen on the workers dime and learn the true definition of what you are. You were such a cumchow that you had to hide behind a weapon instead of facing your adversary face to face like a real Marine or a true man wouldve of done. The Marine Corps has had a long living creed of Once a Marine, always a Marine. You no longer reserve the right in the recitation of that creed. What you can proudly say now is; Once a convict, always a convict. Im sure your grandpa and great-grandpa Buster & Willard are proud of you as they lay in the grave now; wouldnt you think? Dont think that I dont know the Grate family. Officer Bartels comes from a family that is no stranger to the Marine Corps. Officer Bartels father was a Marine, his brother was a Marine, his uncle was retired Marine Corps Drill Sgt from Camp Pendleton, CA. Officer Bartels cousin, son of Sgt Bartels, is retired Lieutenant Colonel who flew sorties during the Operation Dessert Storm and engaged in air to air combat in his F/A 18 Hornet and the A/V 8B Harrier II as well as responding to ground to air anti-aircraft missiles. You are far from calling yourself a Marine. I had a difficult time understanding the history of you playing the whole game in complaining of having symptoms of Post Tramatic Stress Disorder. How did you gain PTSD from being a mechanic, Mr. Miller? Did you change too many flat tracks on the tanks or what? If you truly want to know what PTSD is and how it affects a persons life then perhaps you should take a walk in My footsteps now after a16 year career of law enforcement where I watched a person blow his brains out with a .45 caliber handgun, or the evening I pulled a 16 month old baby from a pool and performed CPR only for her to die in my arms. I watched a steering column be pulled from a screaming womans chest who then immediately died, I was dragged up a city street and suffered a significant wrist injury only to keep an elderly gentleman from driving and endangering other traffic. I have had the undesirable experience talking to a woman on a 911 call regarding a domestic situation and then listen to a bullet enter her head that was fired by her boyfriend. I had to listen to this innocent woman take her last breath. How would you handle, as I; discovering & investigating dead bodies that are in rapid decomposition from unbearably hot temperatures and then discover a body where cats had eaten the flesh from a victims face during sub-zero weather. Or investigate numerous brutal suicides or the time an elderly gentleman went to see his wife in a nursing home only to shoot her once in the head and then take his own life with a bullet ripping through his head. Now, because of you, I have suffered a critical gunshot and have gone through 13 extensive surgeries because of YOU! I have undergone excruciating therapy because of YOU and will be facing at least two more surgeries and another year of therapy. It was discovered recently the only reason you wanted a diagnosis of PTSD on your veterans file so you can receive a government check. You people really know how to work the system. How pathetic in using the system. Now, all I do is fight with workers comp and All I want is to go back to work to put trash like you in the receptacles where you belong. I will be reporting your felony conviction to the Veterans Services and to the Social Security Administration that will make you ineligible for certain benefits if you make it out of the State Prison so years down the road you know will already know why you cant get specific benefits. While I continue to work diligently in regaining my function ability through recovery, you will have plenty of time to think about what you have done to everyones life. Im sure your girlfriend will not go 20 years without a companion so you just as well kiss her goodby. That brings up another good point. Im sure what will end up being your ex-girlfriend will not expose your child to a state penitentiary of your housing to visit you. You robbed your childs life of growing up without a dad.....with the cumchow you are, maybe thats a good thing. Your child doesnt deserve to be around such a disrespectful cumchow as you. Im sure youre child will be raised by another person who is way way better off than you and will be referred to as a real Dad. In closing Your Honor, the defendant, Mr. Cole Miller made a statement on the night of his arrest to Dep. Harvey that he was going to take the officers out as they drove up the driveway. Additionally, at the same time the defendant stated to Dep. Harvey that he wanted to show the officers that he meant business. I ask you, Your Honor, on behalf of Myself and my family that you demonstrate to the defendant, and take into consideration of the extensive medical care I have had to endure, that you mean business as you hand down a sentence to the defendant who has caused nearly $700,000 in unnecessary costs to the BWC as well as jail keep and your time on the court docket. Your honor, in pleading with you on behalf of Myself and my family, that you truly mean business when defendants execute crimes against the law enforcement of the very jurisdiction youre a resident of.
