In Sam Clovis latest ad he challenges the current Treasurer for a lack of oversight for his role as an IPERS board member that led to the theft of millions of dollars of fund assets and for his role in assisting his former staff member and campaign donor, Karl Koch, take over the IPERS fund as its Chief Investment Officer. Prior to the current State Treasurer assisting Koch in becoming the CIO, Koch worked for Fitzgerald and contributed to his campaign. Koch recommended the board take a higher risk Private Equity portfolio and was part of the Request for Proposal process that brought Westridge Captial to the pension board. The two principals of the firm stole 339 million from the fund. At the June board meeting, Koch was asked about the level of due diligence he placed on the managers of Iowa Employee pension money when they make investment decisions. Koch admitted I do not review or approve the investors decisions. I give them discretion. I dont get into the weeds! Moments later the current State Treasurer voted to give Koch more authority and less oversight. Lynden Lyman, another former Iowa Attorney General employee that worked closely with the current treasurer, helped him establish legislation for unclaimed property that has yielded Lyman millions. In the years since establishing the program, Lyman has established a firm to shake down companies into registering with the firm so they can conduct automatic audits or face lawsuits for noncompliance. Lyman and his partners are among Fitzgeralds top donors. Sam Clovis said, We need a custodian that works for the people of Iowa and not millionaires that make it harder for Iowa businesses to be successful. We also need a custodian that will use our public resources to target new investments instead of voters! Sam Clovis has been a vocal critic of the corruption of the incumbent treasurer. For years the current treasurer has used public funds to advertise himself through expensive TV and Radio commercials in a scandal which has come to be known as Commercialgate. After Clovis contacted the Iowa Broadcasters Association in July, the organization sent warnings to broadcasters causing them to either pull the Television ad or air it without the name and likeness of the incumbent candidate. The incumbent then began a radio campaign using public resources. Clovis committee contacted the major statewide radio network airing the ad causing them to reproduce the spot without the incumbents name and voice. Due to the Great Iowa Treasure Hunt containing Michael Fitzgeralds name and logo, this is considered political advertising under Iowa Code 68. Under a normal digital online campaign it wouldnt fall under the same regulations under FCC rules like he was caught with under Commercialgate scandal. However, as the Clovis committee continued to shut down his attempts on using Broadcast mediums to air ads he had to move the public money to a venue unregulated by the FCC since he was shutdown with Commercialgate scandal. It did not escape the state requirements of campaign advertising. If the the TV and Treasure Hunt/iPad giveaway are talked about on news stations the regulatory agencies could come in and rule more authority just like they did with the Commercialgate scandal. What Michael Fitzgerald has done is overt attempts to usurp the policies and regulations and he has continued to brand his name on a broadcast stations or any other means of mass communications to influence the outcome of an election. The current Treasurer was challenged on live Television on the criticism of Cloviss committee and asked point blank if the publicly pad ads were campaign ads. The Treasurer responded, Yes it is! He has been in the office so long that he intrinsically believes that the resources of the State Treasurer belong to him and not to the people of Iowa. The incumbent treasurer has refused to debate Sam Clovis.
