Free the yandina 5 Posted by Jeff Stevens · Yesterday · Edited . Heres a question. When did the law change that allows punishment without conviction? More later.O.K. let’s look at the new anti-hooning laws here in Qld. These laws are supposed to make our roads safer. Well there is a guy here on the sunny coast that is charged with Making excessive noise and smoke. Please tell me how excessive noise and smoke is contributing to our road toll? But that’s not the point of this story, this bloke was charged by a cop- and allegedly was doing a hard take off and spun his wheels, so the cop charged him with this offence and then seized his car. Firstly under our system of law, all people are considered innocent until proven guilty in a court of law, so until he goes to court he is still innocent. Question - if he is still innocent why can the police steal his car and impound it until he gets to have his day in front of a magistrate? Surely this is punishment without conviction and is solely based on the say so of an officer based on his interpretation of what constitutes a crime. You can commit a serious offence for example rape, drug offences, robbery, assault and get bail and go home to a normal life until you get to a court and have your say, no penalty, but here we have a person who is being punished before trial by the loss of their property, in this case a vintage car worth $60,000, im`e sure there are many cases where this law has been used. What if the court finds him not guilty? He has lost his car for months. How is this not punishment before conviction? The thin end of the wedge is inserted, stand by for more penetration. Down with NEWMAN POWER TO THE PEOPLE… Smithy out…
