I often have to sue on behalf of my clients for car accidents, and the most often asked question by a jury is, “Did the Defendant have insurance?” If you are on a jury, the named Defendant is the alleged at-fault party (not the insurance company behind them). The court/attorneys are not allowed to tell the jury whether or not the Defendant has/had insurance coverage. However, the three things an attorney looks for before accepting a personal injury case are the presence of (1) Defendants liability, (2) Plaintiffs damages, and (3) the Plaintiffs ability to recover money damages from the Defendant. In all likelihood, if a person is being sued for a personal injury, theres insurance coverage present to hire an attorney to defend the case against the Defendant and pay out any award on his/her behalf.
