ILLEGAL FARMERS MUST LEAVE ‘BUSHMANLAND’ I say, comrades, the Namibian Police have given some 31 illegal ethnic Ovambo farmers an ultimatum to vacate the Tsumkwe West area immediately. NamRights agrees with the NamPol ultimatum for various legal and constitutional reasons. First of all, the area has been reserved for the socially, economically and educationally marginalized by the past (and present) discriminatory laws and or practices. In terms of Article 23(2) of the Namibian Constitution, the Government is authorized to enact legislation providing directly or indirectly for the advancement of persons within Namibia who have been socially, economically or educationally disadvantaged by past discriminatory laws or practices, or to implement policies and programs aimed at redressing social, economic or educational imbalances in the Namibian society arising out of past discriminatory laws or practices. The ‘Bushman’ people have long been discriminated and are still among some of the most vulnerable sectors of our society. Therefore they must be protected against illegal encroachments of this nature. However, NamRights also advises the Police to first obtain a court order authorizing the eviction of the illegal farmers, because evicting them just like that could also be illegal and an illegality cannot be fought with another illegality.
