Let share my 2 pesos about the issue in Taguig vs. Makati, re: Fort Bonifacio/BGC. Taxes Makati wants that all 20 years worth of taxes paid to Taguig in the disputed areas must be given to Makati- parang utang lang. WTF? This one takes the cake! Taxes are for the people and owned by the people not by the LGU. Taxes should be used in the development and sustenance of the community. Hindi po ito personal na pera. When the disputed areas paid their taxes to Taguig, it is because Taguig is their partner in development. Therefore, during those times, Taguig provided security, city services etc. to the people. Ibig sabihin, kung ginamit nga sa tama yung taxes, napakinabangan na ng mga tao na nagbayad mismo (dapat sana)! Ano ang pera na binabawi ng Makati kung gayon? Ewan ko din. Ang taxes dapat binabalik po sa tao at hindi tinatago o kaya pinagpapasa-pasahan. If we presume that the taxes paid by the people were used in the manner that it is supposed to be, what are the taxes Makati is trying to recover from Taguig? Hmmmmnn. Pulitiko nga naman. Finality of the Decision To have force and effect, decisions of all courts, whatever level, must be final and executory. Everything that is contained in the decision cannot be enforced pending its finality. Basically, even if it is contained in the decision that Taguig must cease and decease ASAP from exercising jurisdiction over the disputed areas it is still without force and effect without finality. The court ruled in favor of Makati, yes indeed, pero hindi pa pwede pitasin ang bunga kung hindi pa hinog. Status Quo; Quashal of the Preliminary Injunction Here goes Makati again. Representatives from Makati say that because the PI issued against them was quashed, they can immediately take over the disputed areas. This is BS. The PI was issued to prevent them from exercising jurisdiction over the disputed areas. Therefore, quashal of the PI means they are not prevented by court anymore- true. However, nothing in the quashal also states that they can take over the disputed areas nor prevent Taguig from exercising jurisdiction over the disputed areas. Makati says "Status Quo"- true. What is status quo in this case? Status quo in this case in DISPUTE- that is why a case was filed in the first place. Makati to say that status quo is they own the disputed areas is self serving. Kaya nga pumunta sa korte para malaman kung sino ang may ari kasi sa umpisa pa lang, may dispute na. So, hanggang hindi pa final ang decision, disputed pa rin ang area. So, brasohan na ngayon kasi wala na nagpreprevent sa magkabilang panig na "hold your horses!". 2 pesos. I post to be corrected.
