On Tuesday, the Court in Wood v. Moss unanimously held that secret service agents—who had moved protestors away from then-President George W. Bush as he dined outside—had not engaged in viewpoint discrimination in violation of the First Amendment. Speaking for all of her colleagues, Justice Ginsburg found a legitimate security rationale for the move, and therefore held that the agents were entitled to qualified immunity.
