PCA CHAIRMAN APPOINTMENT IN HARYANA UNDER HIGH COURT SCANNER Punjab and Haryana high court on Monday restrained the Haryana government from making appointment to the post of chairman of state police complain authority. A division bench comprising Chief Justice Sanjay Kishan Kaul and Justice Arun Palli, however, made it clear that the state can make the appointment as per procedure prescribed by the Supreme Court in 2006 in Parkash Singh case. The bench has also issued notice to the Haryana government seeking its response on the issue raised in a public interest litigation filed by advocate H C Arora. The petitioner had argued that the apex court had in its judgment in Parkash Singhs case, directed that chairperson of the state level police complaints authority should be a retired judge of Supreme Court or that of a high court. It was further directed that such a chairperson should be chosen by the state government/UT administration out of panel of names to be given by the Chief Justice of the concerned high court. Petitioner expressed apprehension that like Chandigarh, Haryana may also appoint a retired IAS officer as chairman of PCA without following procedure prescribed by the apex court, and prayed for restraining the Haryana government from making such appointment without following procedure as mandated by the apex Court in Parkash Singhs case. The Haryana state police complaint authority is not functioning following the completion of tenure of previous chairman H S Rana in September last year. The case would now come up for further hearing on April 7.
