"The Court of Appeals has upheld its decision clearing fugitive and former Palawan Gov. Joel Reyes of murder charges for the killing of environmentalist and broadcaster Gerardo “Gerry” Ortega in 2011. In a six-page resolution penned by Associate Justice Angelita Gacutan, the CA Special Tenth Division voted 3-2 in denying the motion for reconsideration filed by Justice Secretary Leila de Lima after she failed to observe "proper procedural protocols" when the DOJ recommended murder charges against Reyes. “We stress anew, that our decision has not clipped any power of the Secretary of Justice to review the finding of any prosecutor but that power should be used by observing proper procedural protocols in accord with the rules governing investigations,” the appeals court said."
