The Judiciary In SVG ---------------------------------- First let me say, I admire Bigger Bigs for his vision, innovation, entrepreneurial spirit and his willingness to provide needed jobs in St.Vincent and the Grenadines for Vincentians. However, I vehemently disagree with his approach in resolving a business conflict with the government. I am not as schooled as many on the intricate details of Bigger Bigs story, but I understand enough about the matter to formulate an intelligent opinion. Maybe others with more in depth knowledge would nudge me where they feel I am off base in summarizing the facts of the case. As I understand the Facts and Circumstances, Bigger Bigs business was closed by the government for environmental hazards. The government contents that the mining of aggregate used in the building of concrete block was posing a health risk to Vincentians. Now, I dont believe that any sensible individual would argue that the government should not protect the health of the Vincentian people. What appears to be the core dispute can be summed up into two simple categories; 1. Whether or not the business caused a health risk and 2, whether or not the governments action was retaliation for Bigger Bigs switching his support to the NDP. To answer the second question, we can look at how the government response to others who support the NDP for some sort of clue as to an indication that the government retaliates against supporters of the NDP. This issue is very subjective since there are a lot of relevant details in each case that will never be known to the public. However, it is much easier to identify a pattern if the govern targets only NDP supporters. Based on what I have seen so far, I do not believe that the government targets NDP supporters. There are numerous individuals that are employed within the government that openly criticize the government on Facebook. I have seen legitimate cases where individuals could have been dismissed for posting on Facebook during work hours and posting profanity as well. So I am not convinced that the government targets these individuals otherwise, they would be on the unemployment line. The first question as to whether or not Bigger Bigs business was a health hazard to Vincentian is one only the judiciary can decide. Within the court, the government would present their evidence and their experts would testify. Bigger Bigs would have the same opportunity to present his evidence and experts. However, Bigger Bigs has blatantly refused to take his issue to court. The contention is that the court is crooked. This contention that the court is crooked is coming from lawyers as well as others. Now, we must ask who is the court? Is the court the building or the legal professionals who swore an oath to be impartial in rendering justice? How did the court get such a disparaging reputation? This is a simple question to answer. It gets it basically from the corrupt and crooked lawyers. This is not something that is limited to one political party. Within both parties, there are crooked lawyers who give the judiciary a bad name. We recently saw the behavior of Tamara Marks. The ULP was roasted on that. However a chief NDP lawyer and adviser, Kay Bacchus Browne was accused of doing something similar to what Tamara did and served jail time. However, her conviction was overturned on appeal. There are many who believe that she was released because of her political connections. She is still a practicing lawyer in the country. Senator Vynette Frederick of the NDP will soon have her day in court where she is charged with deliberately submitting a false statement which she signed to the court. She is a lawyer who made an oath to be truthful and to uphold the integrity of the court. However, she is charged with breaching that integrity. The Bigger Bigs case has become a political football and the judicial has become a scapegoat, but Bigger Bigd cannot legitimately blame the court system. He must blame the lawyers, many of whom he has advising him, for defiling the courts with their lies, thievery and other criminal behavior.
