These are actual real life excerpts from the governments controversial new Migration and Maritime Powers Legislation Amendment. The Bill amends the act to: • Clarify the availability of the removal powers independent of assessments of Australia’s non-refoulement obligations - non-refoulement being the legal principle forbidding the return of a refugee anywhere they can be threatened. As explicitly stated above, we can now remove individuals INDEPENDENT of these obligations • A vessel, aircraft or person may be taken to a destination that is not inside a country whether or not Australia has an agreement with the country, and irrespective of the international obligations or domestic laws of any other country - hereby legitimising the dumping of refugees anywhere we like But the most frightening of all: • Remove most references to the Refugees Convention from the Migration Act and replace them with a new statutory framework which articulates Australia’s interpretation of its protection obligations under the Refugees Convention - right from the horses mouth. We now have the power to interpret our international refugee obligations HOWEVER WE LIKE! Incredible and totally absurd - these amendments are now part of the legal composition of this country.
