I am not aware the rules. Can anybody enlighten me over this subject? When somebody is charged and sentenced by a competent court. How to tackle that matter? Suppose a man was caught by the police for his un-lawful act, produced in a court and the court after going through the prosecution charges. Sentences him to jail term for a certain period or if the complaint is very serious, may be sentenced to death penalty. How the accused tackle this situation? What are his rights? Can demonstrations and make shift hunger strikes, bus burnings by his supporters save him? Or a PM can order his release? The answer is NO, because once sentenced by a lower court, the accused can seek justice from the High Court, if confirmed by the High Court also, and he can go to Supreme Court for a final ruling. The Prime Minister or the President of the Country has no right to intervene in the verdict pronounced by the Court, but when a mercy petition is received by the President on a death sentence, the President either grant him mercy or reject it. Such being the case some political parties in Tamilnadu is accusing the PM of India and the President of Sri Lanka. The ugly part of the agitation is they are accusing both the Indian PM and Sri Lankan President is Unisom in sentencing the 5 fishermen of Tamilnadu arrested under narcotics smuggling case. The sad part of this agitation is that some lawyers are also participating politicalising this agitation. These buggers are demolishing the entire structure of the “Law and Judicial” system not only of India but also other Indian neighboring sovereign Republic Countries. It seems these people once again trying to revive “Katta Panchayat”.
