TO: 04690073 SUBJECT: post- conviction relief, parole DATE: 10/03/2012 08:30:03: AM Dear Alden: We have devoted an extensive amount of time reviewing the case material you have provided. Now I have a good picture of the case history & facts. I am satisfied that you did not commit the homicide. How you wound up with such a lengthy sentence speaks poor of your former lawyer who was grossly incompetent. There are two ways to go, & the legal avenues are note mutually exclusive. First if a compelling case can be made for innocence, then the likelihood of success would be good. However, we need evidence that was not previously presented, i.e., newly discovered evidence. Second, you are clearly interested in seeking parole, which is understandable. Normally, we do not engage in parole efforts because we litigate with the objective of clearing clients and/or saving their lives from the death penalty (which fortunately does not apply to you). The two goals, exoneration and parole, overlap. It would be my recommendation to consider both. That would be expensive. You might first focus on parole & see what can be developed as to innocence. However, legally one cannot sit on his rights. If there is newly discovered evidence, it must be pursued and presented in court. I am willing to represent you. Yet, I cannot do so without us meeting. Absent that. I cannot help you, anymore than I would anyone else under such circumstances. I have never represented anyone without a viable attorney-client relationship, and will not so now. Please let me know how you wish to proceed. Your patience is appreciated. With best wishes, Robert -------- Robert R. Bryan Law offices of Robert R.
