...The Consumer Protection Act (No. 68 of 2008) (CPA)1 aims to protect and develop the social and economic welfare of consumers, in particular potentially vulnerable consumers.2 It applies to all transactions in South Africa that involve the supply of goods or services,3 unless exempted.4 The definition of a consumer includes a patient.5 Despite its noble objectives the application of the Act to the health care sector creates practical challenges and uncertainties. Health care establishments and practitioners must ensure that they comply with the CPAs onerous and stringent requirements.
